General Terms and Conditions

Overview

These terms and conditions are drawn up by WYS Trading. The terms "we", "us", and "our" refer to WYS Trading. We offer our products through external sales platforms, including Marktplaats, eBay, and Vinted. By placing an order with us through one of these platforms, you agree to the following general terms and conditions.

Article 1 – Applicability

These conditions apply to all offers, agreements, and deliveries from WYS Trading. Because the sales take place via external platforms, in addition to our conditions, the general terms and conditions and buyer protection rules of the relevant platform always apply. In the event of contradictions regarding payments or platform-specific functionalities, the rules of the platform prevail.

Article 2 – Our Products

We primarily deal in products obtained from bankruptcies. This assortment consists of both new and second-hand items. We make every effort to display the colors, details, and any signs of use of our products as accurately as possible in the photos and descriptions.

Article 3 – Prices and Payment

The prices for our products in the advertisements may be changed without notice. Payments are processed exclusively and securely through the integrated payment systems of the platform where you make the purchase (such as iDEAL via Marktplaats or the Vinted wallet). We do not process, request, or store credit card or bank details of buyers ourselves.

Article 4 – Shipping and Delivery

Shipping takes place via the shipping options we offer on the relevant sales platform. The delivery time and the risk of shipping are determined by the chosen carrier and the conditions of the platform (for example, whether or not to ship insured).

Article 5 – Returns and Right of Withdrawal

Because we are a business seller, you as a consumer have the right to the statutory right of withdrawal. You have the right to cancel and return your purchase within 14 days of receipt, without giving any reason. See our return policy for further clarification.

The product must, if reasonably possible, be returned in its original condition and packaging.

• For second-hand products, the item must be returned in exactly the same condition as when we shipped it.
• The costs for the return shipment are borne by the buyer, unless the product is defective or was delivered incorrectly.
• Refunds are processed via the platform or, if this falls outside the platform's timeframe, refunded by us within 14 days after the return shipment is received in good order.

Article 6 – Warranty and Liability

For new products, the standard statutory warranty applies. Because we also sell second-hand goods from auctions, we offer the statutory warranty for these that suits the nature and the specifically stated condition of the second-hand product: it must do what you can reasonably expect it to do.

WYS Trading is solely liable for direct damages resulting from intent or deliberate recklessness on our part. For damages caused by a defect in the product itself (product liability), we will refer you to the original manufacturer of the item, unless the law strictly prescribes otherwise.

Article 7 – Personal Data

To process your order, we only receive the necessary details via the sales platform, such as your name and delivery address. We use this personal data solely for shipping and our legal administration. Your data will never be used by us for marketing purposes or sold to third parties.
